Mandate

General Assembly requests the Secretary-General to examine the request by the Cambodian authorities for assistance in responding to past serious violations of Cambodian and international law, including the possibility of the appointment, by the Secretary-General, of a group of experts to evaluate the existing evidence and propose further measures, as a means of bringing about national reconciliation, strengthening democracy and addressing the issue of individual accountability (A/RES/52/1385).

In accordance with resolution 52/135, in July 1998, the Secretary-General created the Group of Experts for Cambod/ia with the following mandate: (a) To evaluate the existing evidence with a view to determining the nature of the crimes committed by Khmer Rouge leaders in the years from 1975 to 1979; (b) To assess, after consultation with the Governments concerned, the feasibility of bringing Khmer Rouge leaders to justice and their apprehension, detention and extradition or surrender to the criminal jurisdiction established; (c) To explore options for bringing to justice Khmer Rouge leaders before an international or national jurisdiction. Mandate Human Rights Council decides to establish, for a period of one year, a commission of inquiry comprising three members, one of whom should be the Special Rapporteur, with the other two members appointed by the President of the Human Rights Council.

Human Rights Council further decides that the commission of inquiry will investigate the systematic, widespread and grave violations of human rights in the Democratic People’s Republic of Korea as outlined in paragraph 31 of the report of the Special Rapporteur,30 including the violation of the right to food, the violations associated with prison camps, torture and inhuman treatment, arbitrary detention, discrimination, violations of freedom of expression, violations of the right to life, violations of freedom of movement, and enforced disappearances, including in the form of abductions of nationals of other States, with a view to ensuring full accountability, in particular where these violations may amount to crimes against humanity

Resolution 34/22:
Human Rights Council decided to dispatch urgently an independent international fact-finding mission to be appointed by the President of the Human Rights Council to establish the facts and circumstances of the alleged recent human rights violations by military and security forces, and abuses, in Myanmar, in particular in Rakhine State, including but not limited to arbitrary detention, torture and inhuman treatment, rape and other forms of sexual violence, extrajudicial,  summary  or  arbitrary killings,  enforced  disappearance,  forced  displacement and unlawful  destruction  of  property,  with  a  view  to  ensuring full  accountability  for perpetrators and justice  for victims, and requests the fact-finding mission  to present to the Council an  oral  update at  its  thirty-sixth  session and  a  full  report  at its  thirty-seventh session

Decision 36/115:
Human Rights Council decided to extend the mandate of the independent international fact-finding mission, and to request it to present an oral update, to be followed by an interactive dialogue with the Human Rights Council at its thirty-seventh session, to submit its final report for consideration by the Council at its thirty-ninth session, to be followed by an interactive dialogue, and to present that report also to the General Assembly at its seventy-third session

Resolution 39/2:
Human Rights Council decided to extend the mandate of the independent international fact-finding mission, established by the Human Rights Council in its resolution 34/22, until the new mechanism is operational to ensure that the large and continually increasing amount of evidence of human rights violations and abuses it has collected is fully documented, verified, consolidated and preserved in order for the material to be effectively shared, accessed and used by the mechanism, and requests the fact-finding mission to submit a final report on its main activities to the Council at its forty-second session.

Title International, Impartial and Independent Mechanism to assist in the Investigation and Prosecution of those Responsible for the Most Serious Crimes under International Law committed in the Syrian Arab Republic since March 2011
Mandate The Mechanism assists in the investigation and prosecution of the most serious crimes under international law, in particular the crime of genocide, crimes against humanity and war crimes, as defined in relevant sources of international law.
Pursuant to paragraph 4 of resolution 71/248, the mandate of the Mechanism encompasses two main tasks: to collect, consolidate, preserve and analyse evidence of  violations  of  international  humanitarian  law  and  human  rights  violations  and abuses; and to prepare files in order to facilitate and expedite fair and independent criminal proceedings, in accordance with international law standards, in national, regional  or  international  courts  or  tribunals  that  have  or  may  in  the  future  have jurisdiction over these crimes, in accordance with international law. Mandate

Human Rights Council requested the High Commissioner to establish a group of eminent international and regional experts with knowledge on human rights law and the context of Yemen for a period of at least one year, renewable as authorized, with the following mandate:
(a) To monitor and report on the situation of human rights, to carry out a comprehensive examination of all alleged violations and abuses of international human rights and other appropriate and applicable fields of international law committed by all parties to the conflict since September 2014, including the possible gender dimensions of such violations, and to establish the facts and circumstances surrounding the alleged violations and abuses and, where possible, to identify those responsible.
(b) To make general recommendations on improving respect for and the protection and fulfilment of human rights, and to provide guidance on access to justice, accountability, reconciliation and healing, as appropriate;
(c) To engage with Yemeni authorities and all stakeholders, in particular relevant United Nations agencies, the field presence of the Office of the High Commissioner in Yemen, the authorities of the Gulf States and the League of Arab States, with a view to exchanging information and providing support for national, regional and international efforts to promote accountability for human rights violations and abuses in Yemen;

The Council requested the immediate operationalization of the mandate, and also requested the High Commissioner to appoint without delay the Group of Eminent International and Regional Experts, by no later than the end of 2017;

The Council requested the Group of Eminent International and Regional Experts to submit a comprehensive written report to the High Commissioner, by the time of the thirty-ninth session of the Human Rights Council, to be followed by an interactive dialogue.
